The Employee Benefits Security Administration (EBSA) is an agency of the United States Department of Labor (DOL) responsible for administering, regulating and enforcing the provisions of Title I of the Employee Retirement Income Security Act of 1974 (ERISA).  The DOL portions of ERISA do not apply to governmental plans and certain non-electing church plans.  All employers are subject to the Internal Revenue Code provisions of ERISA unless specifically excluded.
